I live in Missouri and my brother lives in Texas. We are dealing with probate and assets, etc. because my dad died without a will. He will be going to court proceedings and I would like for him to represent me if possible or if needed. We do not want to hire a probate attorney because we just cannot afford one. We know enough to get by and if we must we will consult an attorney but we can only afford a few hours of help from one. So, I would like to give my brother power of attorney to sign any documents needed or to represent or speak for me in court when he goes to the proceeding for probate. My stepmother is lying about my fathers assets, hiding things, and has already given away some of his gun collection without letting us know. In Texas we are entitled to half of his assets so I believe what she has done is illegal... but that is beside the point. How do I go about giving power of attorney to my brother? Do I need to get the form here in Missouri or does it need to be from/in Texas? Once I have completed the form and had it notarized, then what do I do with that?.
