My mother has a surgery coming up. We had an idea as to how to avoid frozen assets, probate , retain liquidity of other assets, and transfer the house to both names using a quit deed putting the house in both names with it listed as my primary residence, which under state law is allowed. This would make the assets joint owned with me as a secondary. We went to see a lawyer for the will and quit deed. The lawyers separate all parties, including spouses. This was evident from what I saw from the waiting room. Once they got my mother alone they talked her into making as large an estate/probate tax burden as possible using scare tactics and BS. I have a friend who is a retired lawyer from another state. He says this is a common tactic. It allows this lawyer we saw to skim 10% of the estate value off as fees. Is this even ethical? Since it was a private conversation everything will be "hearsay" in court. Is there some way we can actually get this done with the legal documents and get it done the way we want it done as is legally allowed under state law, and avoid another fiasco, or are all lawyers this crooked? As for this law office, I may have to let an old friend set them up for a law suit and ethics hearing. Can a house be joint owned by mother and son in Arizona? If not, then can it still be sold to me for $20, and a quit deed filed putting it in my name. Every state is different. The banking was the last straw. Having her list me as an "agent" on the accounts definitely will put those assets in as part of the estate, and subject them to being frozen upon her death. The scare tactic used to try to encourage that was "what is I get in a car accident, and I get sued?" Why the hell do I pay out the ass for insurance above and beyond the state minimum coverage? This law office preys upon the elderly, and makes sure no one else is allowed in the same room while they do so. Correct me if I am wrong, PLEASE, but that is not part of legal "ethics" is it? It looked more like a hustle, shuck and jive routine to me. I have no wish to cheat anyone, or throw mama outta the house and into the street. I got two of her investments out of some awful bond fund that was bleeding red ink and into a more diversified fund making money at a clip of around $80/day, and into stocks making a profit too. It seems all these lawyers wanted to do was fluff up the estate so they have a bigger amount to skin their 10% off of later. I also have my own LLC to protect myself in my business, and 80% of the time I am going to the store I stop by a shop for business purposes, so the LLC should offer protection there too. Without a witness I assume and complaints to the bar would be useless. Our original plan was a quit deed putting joint ownership on the house, and will, & a power of atty to me if she becomes incapacitated. Now it looks like we are screwed on the quit claim, and may incur taxes if we file again and have to sell after her death. The law is 2 sales in 5 years tax free. . I would like some more feedback from the good people who read these and answer these questions..
