I live in Texas and my husband is currently working in Virginia. We have sold a property in North Carolina (a gift from my grandmother) and will need to have some paperwork associated with the sale notarized. I was advised that we could obtain a Power of Attorney but am curious what state (Texas or Virginia) we will need to get the form from. Is this even the correct process? If so, how do I got about obtaining a Power of Attorney? Any help is appreciated.. Thank you for the quick response :) I have found a Power of Attorney form on the state of Texas website..my followup question is as follows: will the power of attorney form being notarized in Virginia affect the legality of the Texas Power of Attorney Document? Thanks so much!!!.

That's hard to answer without more information. In general, land contracts typically put major maintenance on the owner and minor items on the tenant/buyer, which is legally binding. Take the contract to an attorney who handles real estate transactions or consumer law in your area, and seek representation. You may need to give a specific written notice before filing suit, and you may need to attempt to repair the items yourself and seek compensation from the owner. Most of it depends on the wording of the contract, and then it depends on your state's laws.
