  • Prior to joining the firm in 1983, Mr. Fernandez served as Assistant General Counsel with the Florida Department of Environmental Regulation from 1977 to 1980, and as Deputy General Counsel of the agency from 1980 to 1983. In both capacities, he served primarily as the litigation attorney, but was also extensively involved with rulemaking licensing enforcement and appellate practice. During his tenure as Deputy General Counsel, he was also the attorney assigned by the agency to handle the Department's legislative matters. I would contact an attorney regarding the legality of this, and not take too seriously any information people on Yahoo provide. There may be more at stake than you are aware of. Most attorneys offer free consultations. I'm also confused with whom you are referring to when you say "I found out because they were forced to tell me because I did my own taxes this year and they flipped out when they found out and we went to war over it, everything is calm now though and I gave them my info and they sent it in to be amended." You used a lot of pronouns which seem to confuse your meaning, particularly with respect to 'they' and 'we' when you only mentioned four particular individuals: your daughter, your mother, your deceased father, and yourself.. . I can, however, offer you advice on how to deal with your mother. If you are the beneficiary of the trust, then you are ultimately the one who is entitled to the money. As a trustee, she may have certain obligations regarding how she is to regulate the funds to you, but I can say without a doubt that they don't include her personal displeasure with you or any disagreement she has over your daughter. After all, your daughter didn't exist when the trust was formed and couldn't be a part its terms.. . Since you have asked politely, I would advise you to get firm with her about the nature of the trust and her position in it. Communicate sternly, but respectfully that you don't 'owe' her anything personal as the beneficiary of the trust and that any issue she has with your daughter is beside the matter. If she is displeased with your parenting you need to address that issue with her, but regardless of the particulars, *you* are her father and *you* make the decisions (not your mother). She needs to respect that. If I were you, I would be very resentful of the fact that she is letting her personal issues get in the way of business (the trust fund), which she seemingly hid from you in the first place.. . Even if you find a way to obtain the money you need, your mother will continue to be a thorn in your side until you resolve your disputes. As a trustee she obviously has some power, and I doubt it will be easily wrested from her legally. I would be concerned with what seems to be (based on the information you've provided) a tendency to involve conceited emotions inappropriately.

It depends on how much time has passed. I would always give at least (4) business days before even attempting to contact someone (trying to find out your status). If an interview was on a Monday or I had turned in a proposal on Monday and had not heard from them by close of business Thursday then i would definitely try to contact them on a Friday (this is all just an example).
