im about to go to meditation tomorrow in texas. my original child support was established three years ago. at that time i agreed to $200 a month which was below texas standard guidelines for his income for two teenage girls. Now three years later i want him to pay me the required 25% according to texas guidelines. I already am aware that at the mediation he will have an attorney and try to contest having to pay an increase his child support. I am expecting at to have at least an increase by $200-$300 and he will do anything in his power to avoid having to pay me this amount. What exactly happens in mediation and if no conclusion is made, how long before a court hearing will be set before a judge?.
The first poster is incorrect - "every" state has a statute of limitations for collecting simple money debts.. . Looking through your past questions, if you live in Illinois, the collecting SOL for open accounts (credit cards, etc) in your state is 5 years from the date you defaulted.. . The collecting SOL for written accounts (bank loans, etc) is 10 years.. . If you just received the notice and send them a validation request within 30 days of receiving the notice, they "must" cease all collections until they provide the information.. That includes placing it on your reports or verifying with the CRA's if it is already on your reports and you dispute it.
