• In September 1976, James O. (Jay) Fergeson, Jr., realized his desire to return to Sarasota and establish a "boutique" law firm specializing exclusively in the areas of federal and state taxation, wills, trusts and estates.

  Mr. Fergeson opened his practice in what was then known as the United First Federal Savings and Loan Association Building located on Main Street at Pineapple Avenue. J. Ronald Skipper, a specialist in wills, trusts, and estates, joined Jay in 1978.

  Growing to meet the needs of our clients, the firm expanded with the addition of Andrew Shaw in 1979. As a civil trial attorney, Mr. Shaw's presence marked the beginning of our transformation from a specialty firm to the full service firm that exists today.

  On January 1, 1984, trial attorney David J. Baron and real estate attorneys Stephen B. Keyser and E. Ralph Tirabassi merged their law practice into the firm and Fergeson, Skipper, Shaw, Keyser, Baron & Tirabassi, P.A., was established.

  The continued growth and expansion of the firm and the increase in space demands resulted in a move to larger accommodations in April 1993. The firm presently occupies the 10th floor of the Northern Trust Plaza in the center of downtown Sarasota. The firm offers a full range of legal services to complement Sarasota's growing economy and the expectations of our clients. All services are provided by knowledgeable and experienced attorneys with the assistance of a proficient and dedicated support staff.

  The complexity of both the law and our judicial system have engendered specialization within our profession. In 1982, The Florida Bar initiated a certification program to identify for the general public and the profession those attorneys who have demonstrated special knowledge, skills, and proficiency in certain areas of the law. Most of our attorneys have attained certification from The Florida Bar in one or more of the areas of specialization including taxation, wills, trusts, and estates, civil litigation, appellate practice, and real estate law. Two of our attorneys have been elected to the American College of Trust and Estate Counsel, or ACTEC, in recognition of their skill as trusts and estates lawyers and their contributions to the practice of trusts and estates law.

I am presuming that this is a durable power of attorney, Mom is alive and well and not for mental health reasons? If she is not judged to be incompetent, she can revoke the power of attorney. That will end anything further happening. At that point, I would seriously consider getting an attorney to see about prosecution for funds at that level. I hope you find this helpful

Request a bill, not a statement, so that your & their record on this matter can be reconciled.. . Invite the attorney's accounting staff/secretary to meet you in a dispute resolution/mediation conference.. . These mediators are funded through your local Small Claims Court which is the court of jurisdiction for this matter. Although it may be true that most people talk about emancipation than actually go through with the process, you have a better chance than most. Many people are drop outs and just don't like living at home. They lack the dedication and follow through to complete the process.. . If you have another place to stay where someone would be paying for your living expenses it sounds like they'd be adopting or taking custody of you. This is different from an emancipation. You need to be able to support yourself on your own. This is hard to do on $8. Most people making minimum wage usually have an s/o or roommates.. . 7120. (a) A minor may petition the superior court of the county in which the minor resides or is temporarily domiciled for a declaration of emancipation.. (b) The petition shall set forth with specificity all of the. following facts:. (1) The minor is at least 14 years of age.. (2) The minor willingly lives separate and apart from the minor's parents or guardian with the consent or acquiescence of the minor's parents or guardian.. (3) The minor is managing his or her own financial affairs. As evidence of this, the minor shall complete and attach a declaration of income and expenses as provided in Judicial Council form FL-150.. (4) The source of the minor's income is not derived from any activity declared to be a crime by the laws of this state or the laws of the United States.. . 7121. (a) Before the petition for a declaration of emancipation is heard, notice the court determines is reasonable shall be given to the minor's parents, guardian, or other person entitled to the custody of the minor, or proof shall be made to the court that their addresses are unknown or that for other reasons the notice cannot be. given.. (b) The clerk of the court shall also notify the local child. support agency of the county in which the matter is to be heard of the proceeding. If the minor is a ward of the court, notice shall be given to the probation department. If the child is a dependent child of the court, notice shall be given to the county welfare department.. (c) The notice shall include a form whereby the minor's parents, guardian, or other person entitled to the custody of the minor may give their written consent to the petitioner's emancipation. The notice shall include a warning that a court may void or rescind the declaration of emancipation and the parents may become liable for support and medical insurance coverage pursuant to Chapter 2. (commencing with Section 4000) of Part 2 of Division 9 and Sections. 17400, 17402, 17404, and 17422..
