  • Attorney Jennifer Applegate joined our firm in 2010 to take over our family law practice. She is a 2008 graduate of the University of San Francisco School of Law, where she was the recipient of the Dean's Scholarship and the Zief Scholarship. While in law school, Jennifer excelled at - and won multiple awards for - both oral and written advocacy. She was a contributor and Senior Editor on the USF Maritime Law Journal, and taught a Street Law class at a San Francisco high school. Throughout law school, Jennifer worked as a clerk in the Sonoma County District Attorney's Office, where she was able to put her oral argument skills to use. In addition to many successful appearances in the Superior Court, Jennifer wrote and successfully argued a motion before the Sonoma County Appellate Court.

    Following her graduation and admission to the California Bar in 2008,Jennifer did extensive pro bono work at Legal Aid of Sonoma County. She assisted clients with cases that included domestic violence, schoolyard bullying, workplace attacks, civil harassment elder abuse, and dependent adult abuse. Her work with victims of domestic violence gave Jennifer exposure to the family-law issues of dissolution, support, custody and visitation, and protective orders. Her Legal Aid clients praised her strength, compassion, and approachability, as well as the results she achieved for them.

    Jennifer was born in New York, went to college in Philadelphia, and lived in Boston before moving to the Bay Area in 1996. She loves living in Santa Rosa and is learning Spanish to better assist her Spanish-speaking clients.

My biggest concern & question is:. . Will my husband be effected? He has a healthy retirement plan with his current employer. He was not on the lease or part of the business. Can the building owner go after his assets? Will that be part of the bk?. . Can the bank where the credit card and line of credit were open, go after my husband's asset?. . We don't have a house. So no worries about them taking that.

My mother set up a Irrevocable Trust and put a couple of her properties into it. She has since passed and left me as succeeding her as trustee. I want to refinance the existing loans (in her name and, oddly, my fathers) both to reduce the monthly payment and cash some equity out for the care and maintenance of my father, the beneficiary. I've spoken to a few mortgage brokers and some say they can't do it because it is an Irrevocable Trust and can't be taken out of the trust, while others say they can do it within escrow without taking it out of title. So which is it? Does a property in a Irrevocable Trust need to be refinanced in the trusts name, now that my mother, the originator of the trust, has passed? And if so, who are the banks or mortgage brokers that do this type of loans or specialize in them?. . Thanks in an advance.. Thanks GWKIT and Lin for the quick reply. BTW, the trust was established in California. I will seek legal advice.. . But does anyone know if there are lenders or brokers that specialize in this, I can't imagine this not being a growing new market given that the Baby Boomers will be/are leaving assets, especially property, to there children protected in trusts..
