My father 83 years old has undergone a major surgery, kidney removal due to cancer, last week and is according to the doctor suffering from temporary dementia, so he will not be able to make out any checks. Hospital bills have been high! 2 years ago he opened a joint bank account with my eldest sister. Before the operation he claimed the account has only been credited by SSA direct deposit and that no withdrawals had been done on his behalf. Us other siblings have asked my sister if she could withdraw funds to pay for the medical bills and she has refused to do so. Question is can my mother 80 years old, married to my Dad for the last 60 years, request for the bank to apply funds from the joint bank account to pay for the hospital bills based on the fact that the account is marital community property? Currently all other members of my family are depleting our personal savings account due to the fact that our eldest sister has denegated release of the funds..
