• Andrew Ditlevsen is an associate and is a member of the firm's Litigation and Dispute Resolution Group. Andrew's practice focuses primarily on litigation of banking and real estate related disputes, as well as representation of clients in bankruptcy cases under Chapter 7, 11, and 13 of the Bankruptcy Code. His experience includes cases involving enforcement of promissory notes, personal guaranties and security interests, defense against enforcement of "sham" personal guaranty agreements, construction defects, quiet title, slander of title, fraudulent real estate transactions, foreclosure actions, business torts, creditor's rights and bankruptcy. He has represented individuals and companies in both state and federal courts.

  Additionally, Andrew handles transactional matters for individuals and businesses, including reviewing and drafting promissory notes, loan agreements, asset purchase and sale agreements, and representation in the sale of commercial businesses.

  Significant representations in which he has participated include:

  Representation and defense of real estate developer against claims for enforcement of a multi-million dollar personal guaranty, defeating summary judgment relying in part on the judicially created "sham" guaranty doctrine.Representation of partner in prosecution of action for fraud and breach of fiduciary duty committed by another partner related to the purchase of real estate investment property. After a multi-day jury trial, the jury awarded all damages claimed and imposed a significant punitive damage award.Successful defense, after a multi-day jury trial, against claims for conversion of personal property and fixtures.Representation of an individual-property owner in a dispute with his homeowners association, neighbor, real estate developer, contractors and multiple insurance companies related to construction defects, breach of fiduciary duty, fraud and nuisance claims.Representation of an individual and his wife who were defrauded by an individual and his company in a sum exceeding $250,000 relating to investment secured by first and second deeds of trust on real property.Representation and defense of a former CEO of a Silicon Valley Company, involved in the sale and distribution of pharmaceutical ingredients, against claims of fraud and embezzlement asserted in adversary proceeding.Representation of various individuals and businesses in adversary proceedings, both prosecuting and defending claims for fraud, defalcation while acting in a fiduciary capacity, willful and malicious injury and objection to discharge.

  Andrew first began working at Terra Law in June 2011 as a summer associate and then as a law clerk while finishing his legal education at Santa Clara University School of Law.

  Prior to joining Terra Law as a law clerk in 2011, Andrew was a full-time judicial extern for the Honorable Jeremy Fogel of the United States District Court, Northern District of California. Andrew also worked as a legal extern with the California Franchise Tax Board preparing briefs and motions on a variety of personal income tax issues.
