You have to have the person you want power of attorney from sign it over to you. This is usually done in a legal document prepared by an attorney and filed with the appropriate business or government agency. For instance, if you wanted power of attorney over someone's bank account, you would need a document signed by the other person (and witnessed, usually by a notary public) and filed with the bank. The bank is not obligated to accept the power of attorney, although having it signed by a notary public helps, and you may have to go to court to enforce the power of attorney. If the person you want the power of attorney is incapacitated and can not legally sign the power of attorney over to you, you might have to seek legal action to get the power of attorney.
