If someone is an executrix or executor of an estate.... are there laws in place to make sure?

What does a name change and custody have to do with each other? If your child's dad won't sign then he won't sign. And if your son doesn't like his surname he can always change it when he is age 18. In the meantime a decent mother wouldn't bad mouth the father in front of the child. You should do whatever you can to encourage a relationship between the two of them - and at least be polite to the father when he has visitation. What matters here is your child and his happiness and bad mouthing his father will certainly deprive him of what every child needs - the love of a father. Same is true for the father. If the two of you can't say anything good about each other then put a muzzle on it when around the child and don't say anything at all.. . I do hope you and the father both grow up and think only of the needs of the child and do everything in your power to make sure that he grows up knowing the security that love can give him. Otherwise you should consider not having any more children.
