If you brother is a qualified medical marijuana patient he will have little to fear. According to the California Attorney General, hashish (concentrated cannabis) is as legal as marijuana itself is for qualified medical marijuana patients. My contract states "The agreement cannot be broken mid term by either the tenant or the landlord unless either party has not kept to the terms of the agreement".. . To me this says that the agreement can only be broken if the agreement is broken, so if I just stop paying rent and leave then is there anything the landlord can do about it?. The landlord has been showing prospective new tenants (presumably to take up tenancy at the end of the current multiple occupancy agreements) after asking permission from us to do so

What I get from your question is that you aren't the people that deal with the monetary side of things anyway, so you wouldn't really be able to make a contract entailing monetary exchanges for the pub. So that kind of renders any contract invalid, if you could even call a casual over the phone conversation as a contract.
