Establishing a Living Trust. An individual transfers title of his assets from himself as grantor, to himself as trustee of the trust, to administer for the benefit of himself. The trust also must name the remainder beneficiaries who will take after the grantor dies. The beneficiaries get nothing until that person dies.. . It may be advisable to utilize a corporate trustee such as a bank. A substantial advantage is that a corporate trustee can act in perpetuity, whereas an individual cannot. Furthermore, corporate trustees must provide accurate and detailed records of all transactions that take place in the trust, for however long the trust exists. Those records become what is known as an "accounting" of the trust, which may be required to be provided to a court or remainder beneficiaries. Corporate trustees also are required to manage the investments held in the trust. However, laws have been updated in most states to allow a corporate trustee to act in a "directed capacity", meaning that they are required to have oversight of the trust investments, but not the day to day management of them.

Hmm, why would you not already have letters of reference for the jobs that you have worked? You should always get a letter of reference from an employer as soon as you leave the job. The fact that you are getting them now will raise a LOT of suspicion with the consolate that you are trying to fraud your work experience. If you get them now, make sure you take a few pay stubs and your actual professional reference contact info (ie. previous supervisers phone #) with you when you go, so you can prove that you actually worked there.. . The "no qualified Americans can perform your work" part you can worry about later if you want to pursue a Green Card. For the purpose of your interview and getting your H-1B stamp/I-94 you just need to be able to prove to them that you have an employer in the US in need of skilled labor that has a guaranteed job waiting for you when you get here. They will likely ask you for the original H-1B Cap Case approval letter from USCIS, the original watermarked job offer, start date, salary information, what your intent is (ie. work in US for few years and go back, or come in with Dual Intent and pursue labor certification and Green Card), and all of that stuff. Just be confident and honest in your interview and as long as you are legitimate, you *shouldn't* have any issues.. . Some common things that people get their H-1B rejected for at the consolate include language/cultural issues that will make it hard for you to assimilate, health issues, your skills/experience/education are not credible and verifiable, you lied on your resume, or the US employer is paying you below what the market value is for your line of work in the part of the US that you are looking to work. For example, if you are going to work in New York City for $50,000/year they will probably deny your visa and report your US employer to the Department of Labor. Due to a lot of exploitation that has been going on (specifically with corp-to-corp Indian workers), they do not want employers bringing people in to work for peanuts and locking them into SOW contracts that force them to work 70+ hours per week and only get paid for 40.
