MY QUESTION-. Do I have anything to legally change since my social security number is linked with my maiden name of "Smith"? Or, because our marriage license reads "Smith Jones", is that my legal name therefore requiring me to have a judge officially change my name back to only "Smith"?. . Thanks for your help and your patience! :). ****I appreciate your help! I should add though that I am still married and the situation is not due to a divorce. I simply am looking to drop his last name.****.

General Power of Attorney for any transaction with regard to immovable property can be given by you to any one in India. The GPA has to be on plan paper which should be duly signed by you & few (usually two) witnesses in presence of the Notary Public available in the place/country you now reside. Such Notary Public is also available in the Indian Embassy/Consulate. The Notary Public shall sign & Stamp this GPA & give it to you. The Charges for the Notarization fixed for the place where you get this done. For the admissibility of this document in India this simply notarized GPA is more then enough, no non-judicial stamp paper required, as that is for GPA to be given in India not for GPA from any foreign country. The Person who gives this GPA should carry his Valid Passport to satisfy the Notary public about his identification, a certified copy of the passport should also be sent by the person giving this GPA to the person in whose favor this has be given & got notarized in the foreign country. The Sub-Registrar/Tehsildar who will be registering the immovable property would confirm the identity of the person who has given it along with to which this GPA has been given hence the certified copy of the valid passport of the person who gave this GPA will be required here in India. If you are coming to India then you don't have to give a notarized power of attorney/GPA but this GPA has to be on the Non-Judicial Stamp Paper which has to be registered with the Sub-Registrar/Tehsildar where you reside in India for the time being. The Notarized GPA is acceptable only if the person giving it resides in a foreign country. Edit :- I did not say you get it first Notarized from Notary Public & then sent to Indian Consulate, I simply said that Notary Public are Available in Indian Embassy/Consulate for Notarizing this GPA. Either you get this GPA Notarized by Private Notary Public or from Indian Embassy/Consulate. Once this is Notarized you don't need to get it registered again in (Noida) India it will be completely legal for all purposes.
