  • Allyson Del Vecchio has been a family law attorney in both Arizona and Connecticut. After assembling my estate planning attorney, financial planner, and certified public accountant, I would collect the money using a trust to protect my identity.. . Then I would move to New York to pursue fashion design at Pratt or Parson's (not sure which). After graduating I would have enough money to start my own fashion line and open my own clothing stores, of which I would control every aspect.. . In my spare time I would take dance lessons, learn several different languages, and travel the world. I would make the best food in my gourmet kitchen when I wanted to eat in and have the best cocktail parties with private security, coat check and bartending staff.. . I would set aside discretionary trusts for my family so they would have what they needed without having to ask me. And if they blew through it irresponsibly I could revoke the trust until further notice.. . I would buy my mom a house somewhere coastal, but where there was shopping nearby. Nothing too extravagant as taxes are high on huge houses. I would start a scholarship for underprivileged persons and donate to charities as per my financial adviser.. . No. There is a limit to powers-of-attorney and unless your boyfriend is permanently incapacitated, you can't file for divorce without his explicit consent. And if he was permanently incapacitated, his WIFE could fight your power-of-attorney on the grounds that SHE is his next-of-kin and her husband was in no fit state-of-mind to give a valid power-of-attorney. I am afraid that even if you have this document, his wife has more rights than you do. She may even be able to over-ride that power-of-attorney because she is his wife.. . Before you do a thing...go talk to a good lawyer...explain that your boyfriend was married when he gave you this document and tell the lawyer that you want to force a divorce. I think the lawyer will be able to explain much better than I can about what you can and cannot do with such a document...and I think you will find that you cannot file for divorce on behalf of your boyfriend without his full knowledge and consent.
