A power of attorney gives Person X the ability to act on behalf of Person Y (sometimes within boundaries delineated in the power of attorney). As such, it is a very serious document.. . The role of witnesses is to attest that they actually saw Person Y voluntarily sign the power of attorney. Therefore, the witnesses are really attesting that there was no undue influence by Person X on Person Y at the time that Y signed the power of attorney.. . When the power of attorney is sealed by a notary, the notary is attesting that he verified the identify of Person Y and also of the witnesses and that the document was signed by all in his presence. Therefore, having the document notarised is one more layer of assurance that the power of attorney was granted voluntarily by Person Y.
