Trust law depends generally on three factors:. . 1. Contract law as the estate is created by agreement between the trustor (donor) and the trustee.. . 2. The trust agreement which has to be in writing to satisfy the statute of frauds and any other legislative act in existence at the time of its creation, must also comply with certain other statutes and common law rules, for instance the rule against perpetuities as well as the laws on alienation of property.. . 3. The fact that one of the beneficiaries is also a trustee may weigh in heavily depending on whether or not the intent of the trustor was to make one beneficiary the "manager" so to speak of the property. Typically in an irrevocable trust situation, however, a trustor (or donor) cannot be a trustee and a beneficiary. The whole point is to give up control forever.. . Finally, the courts will look at the intent of the trustor and the trust itself through the lens of a court of equity. It will try and do what the intent of the instrument was. But it will also limit its view of the instrument in light of the laws both in existence at the time of the formation of the trust and also at the time it is being construed.. . There are two other sub-legal issues:. . 1. The trustee even as beneficiary owes a fiduciary duty to the other beneficiaries.. . 2. You can object to any compensation paid to the one trustee/beneficiary as only reasonable compensation and expenses can be paid.. . 3. The first two sub-points is rooted in the fact that the trustee is an agent of the trust and therefore the laws of agency and fiduciary duty apply. That means the highest level of honesty and fair dealing is owed particularly since the trustee fills a dual role as both trustee and beneficiary.. . 4. The trustee is not unfettered and if you can prove that the trustee is charging excessive compensation and collecting expenses to which s/he is not entitled you could have that person removed.. . Finally, its hard to bust a trust especially if there are future generations considered in the body of the trust. Those are people who might or do exist that have a vested interest in the property, even though they are currently not beneficiaries.. . Because of that, without knowing what the trust says, its impossible to say who has what rights other than the usual right under the code and common law.
