I would put it in black and white in a brief and professional way. I don't mean write him any sort of letter. Just create an invoice, there is a basic template on Google or in word. Email him with an attached invoice with instructions on how to pay. If it is the second one you have sent him, label it with "reminder". That's it, nothing personal, just what all customers would receive. Some people are like that and need a reminder or something official. Send another one after two weeks etc. I would only ring him when you are doing account reviews for stocktake or something, which might fall every three months. Then it is easier to bring it up on the phone because you can say you are balancing the books and following up old accounts. Should he want new work from you in the future and has not paid, you can then say that you are giving priority to customers who have settled their accounts in full (so he would have to pay then).

I am not sure about the laws of Pennsylvania, but in CA you would have a case. It is almost clear cut, but you leave me much to question. A trust is much like a living will and whatever is stated on the trust were the wishes of the deceased and common law cannot normally supersede this. I believe the lawyer is correct in his assessment, but it could be fought at some considerable expense.
