The Power of Attorney with regard to any transfer of assests of the immovable property should be registered with the Sub-Registrar/Tehsildar and not Public Notary.. The transfer of immovable property either by sale or mortgage or even if it is leased out for a period more than one year ( more than 12months) etc. has to be properly registered with the Sub-Registrar and proper duty paid for the transfer, any power of attorney given to another person to carry out any of such functions relating to immovable property also required to be registered in the same manner by the Sub-Registrar.

I have worked with people who wanted to refi property in a trust. The lender made them take it out of the trust to refi. If they want to sneak it back in afterward that's up to them. But since it makes it hard for the lender to foreclose on the trust they disallow such maneuvers.
