    The answer depends on who & how many people are involved, how many properties and their use.. . Typically entities are created to get a benefit from the form of the entity. If it is just you and a small number of people who intend to hold one property for a long period and there is no personal liability issue creation of an entity might be an inferior choice compared to simply titling the property appropriately ( joint tenants or tenants-in-common). Entities can create a tax return filing requirment and/or minimum tax payment needlessly.. . Also, like marriages, entities are easy to create & often complicated to dissolve.. . Furthermore, financing will be more difficult and expensive, at least at first, and you likely will still be required to sign personally anyway.. . The main benefits from any type of entity in a real estate holding company are limitation of liability and facilitating changes of principals (ie members or shareholders). Insurance is a better/cheaper way of solving the first problem (if it exists) and until you anticipate selling interests in the property to others than a close group I believe that titling of the property is the first, best plan.. .     Your mother may have a power of attorney form that she had you to sign but it is not valid unless you have been declared mentally incompetent for the things you say she is doing. A POA would give her the right to handle your financial and or medical needs but not to control where you go or who you see unless as before she has a court declaration that you are incompetent, she is convincing you but that she can control where you go or what you do but that is not true.~

    My mom wants me to take care of her afterwards.     For further information get her to check with her local Citizen's Advice Bureau, they may be able to direct her to where to find the required forms. Social Security should also be able to advise. . Not only does she need the forms, but she needs to understand what the Power of Attorney does and doesn't entitle her to do with those funds she may have control over. Also does she need/want financial/medical/enduring power, etc as well?. A doctor's report may be required (confirming that the Mother's condition is both irreversible and that her cognitive and/or physical function/ability is lowered.. With low income she may also be able to access "Legal Aid" to get the appropriate documents filed/notarized, if that is required where she lives.
