Try to get a Health Care Proxy authorizing the physically nearest brother to communicate with doctors and make medical decisions if your father is incapacitated.. . Ideally, you should get a Health Care Proxy or Medical Power of Attorney from a lawyer. Your doctors offiice or HMO may have a standard health care proxy form they give out. (A health care proxy is narrower then a Power of Attorney) Alternatively, you can download them from the internet. If you do that, make sure you get one for your state, and carefully read the instructions on the number of witnesses who need to see your father sign it, etc.. People at the hospital often ask about Health Care Proxies for older patients. HMOs like you to have one.

I work at an assisted living home in KY as a caregiver. One of the residents currently has an open wound on her leg. The wound started out as what looked like a scratch and has gradually over the course of 3 weeks gotten much bigger. The resident itches it and is constantly looking for someone to help her with her pain. The issue was addressed when the wound was discovered, right away to her POA, which is also her son. Her son does not believe in medicine or doctors, and has refused to take her to the doctors. Because it is an open wound, and has not healed, the resident services director has demanded that a home health service come in to dress the would. I geuss you cannot have unhealing, open wounds to live in assisted living. She was in tears tonight bc of the pain her leg was in, she was saying she needed to get to the doctors, or hospital bc the pain was just too much. I observed that her leg was very red and hot to the touch, as it has been for weeks now. You don't have to have a medical degree to know that this leg is infected. I called my boss to ask if I could call 911 for her, and she said to call her son (even though we both know he is going to deny her that right) It went agains my better judgement to call my boss before I called 911, but knowing his religous stance on DRs and medicine, I felt obligated to call my boss first. Of course when I did call her son, he strictly said NO hospital. He said that a home health agency has been to see her yesterday and will be back monday. To me, that is irrelevant, but whatever. Does he even have a RIGHT to deny her 911, drs, meds, etc based on HIS religious beliefs even if he is her POA??.
