My mother has lived with this man for 3 years. They have considered each other husband and wife and I believe are common law. They had not legally married because he wanted to wait until his spousal maintenance ended from his first marriage. He had some medical problems 1 month ago and he had to be rushed into the hospital. He was in ICU for 3 weeks and has now been moved to a long term care facility. We completely expect him to make a full recovery. However, he paid the mortgage, the electric, and the water and my mother paid the phones, cable, groceries, etc. They have separate checking accounts. She is fearful of being foreclosed on while he is recovering. My mother does not want access to his accounts, but he does have a grown son who is 29 years old who lives in the same town. What would the son have to do to get power of attorney so that he could pay the bills out of his dad's account? The spousal maintenance as well as child support on his other two kiddos needs to be paid to. Mom wants to help keep everything together so he doesn't come back to a big ol mess. Any help would be appreciated. Thank you.. I have been searching and I see the POA form, thank you. Unfortunately, dad is on a ventilator.. supposed to be trached on Monday. He is sedated because of being intubated, but hopefully once he has the trach in they will let him be fully awake. He still has all of his brain function he knows who everyone is and is still fiesty enough to try to fight the nurses and the machines when the sedetives wear off (it's horrible, I know, but it makes us all feel a little better to see him still be stubborn). So, if he is not sedated with the trach in then he could sign the form or really just write the checks from the hospital himself. The son is definately trust worthy, he is a good guy. My mom, although they are seen as husband and wife by both families, is not going to get into his money without him saying so. Should something horrible happen to him it would go to the oldest son as the excutor of the estate anyways, that is why mom figured the "right thing to do" is to let the son do it.. I think I am looking for help with obtaining temporary guardianship...

I would say that is a very good start, and it is as I suspected that they knew that they were doing some things that were not correct.. . I will guarantee you that no builder gives up $50,000 per property if they were not doing something wrong.. . I recommend that you show my response to your attorney to see if you can't get something like $100,000 or more from these crooks.. . I am sorry to hear of the problem that you have had with this builder.. Unfortunately this kind of thing has been going on all over the United States. It is time that we put a stop to it.. . One of the best ways to discourage the sort of bad behavior that these developers have been engaging in is to take legal action against them and expose the fraud.. . Also some of the people who responded said you had no case. Those people do not know what they are talking about.. . They are not attorneys, they are not licensed to practice law, and some of them may be real estate agents.
