My partner and I are in the middle of applying for a mortgage, so we both decided to view our credit reports on line. I was totally shocked to discover a big fat 8 on my report from a company called Cabot Financial. They filed the default in Feb of this year. I contacted them and they said they were acting for Barclay Card. I had a card with them 5 years ago, and as far as I was aware I paid everything off and destroyed the card, if I owed them anything it was under ?100. Ive since moved house twice since then. Yet on my report Cabot are stating Im ?1400 in default. . Barclay card state they no longer have records on my account as it was passed on. Im aware there is a template of a letter to send to them asking to see my original credit agreement, does anyone know how I can go about this? . Can I insist this is taken off my credit report? . Who do I dispute the default with? . And how long will this take?. Ive been so careful with my money and bills this last five years and to see this is a complete kick in the teeth. Especially now I need to apply for a mortgage... Any advice would be great thank you..

I notice in some cases it's better to have both. Is it better to have just a revocable living trust or just a will? I don't have a lot of assests but I heard it's good to set that up to skip probate..

Your question has less to do with investments and more to do with trusts and estates law. Typically, parents set up living trusts to hold assets until a child reaches the age of 30. This provides protection as creditors cannot attach the assets in the trust if there is a spendthrift clause. It also prevents young people from "blowing" the money in Vegas or some such way. Many parents like this. We estate planning attorneys call it "parenting from the grave." Fortunately for beneficiaries there is usually a power of invasion in trust instruments. The standard usually allows the Trustee to distribute funds at ANY time for a beneficiary's health, education, support and maintenance. That means all of the funds might actually be used before a beneficiary like you turns 30. Thus, how the assets of the trust are invested are not really relevant as to your access to them. Of course, you must actually read the trust itself to see what it says. It will probably confirm what is said here but it is also possible that the trust varies in some other significant way.
