If your parents do consult with a solicitor, make sure it is one who specialises in property rental as most 'High Street' solicitors are not that good with L&T law.. . My advise is based on the assumption that the original tenancy agreement was an "Assured Shorthold Tenancy" in England or Wales and that the rent is less than ?25k per year.. . The rolling contract you describe (unless a specific document has been signed) is a Statutory Periodic Tenancy. This has all the same conditions as the original agreement, except notice from tenant is a minimum of 1 month and from landlord - 2 months. Both to expire at the end of a period (ie if original tenancy ended 25th December, the period is 26th to 25th). These notice periods are in the 1988 Housing Act.. . Did your parents give notice using a notice as specified in section 21 of the 1988 act? If not, it won't be valid. Section 21 is the way to end a tenancy if no one is at fault. If the paperwork is done correctly then there isn't usually a court hearing and the judge MUST grant your parents a possession order.. . A notice under s8 of the Act can be issued once 2 months worth of rent is unpaid. Once issued, you can apply to the court 14 days later. This will require a hearing but, providing the rent is still 2 months unpaid at the hearing date then an order must be given. With a s8 the judge can also make an order for the missing rent.. . Once you apply to the court for either of these, you will probably have to wait at least a month for the court hearing. The judge will probably give the tenants 14 days to leave. If they don't leave, you will need to employ court bailiffs (another months wait) who will physically remove the tenants.. . Harrassing tenants is a bad idea and can result in a conviction.. .
