A very astute asker raised these points. I'm reposting my reply hoping to help others. Trying to phrase it as a question. I'll be open to email if anyone has further questions. (Trying to stay within the community guidelines!). . So the "question" is, are you aware of these issues?. . I hope this will be well-recieved. It is well-intended. The original question dealt with gay partners making medical decisions.. . It is best for this question to be decided before-hand. Regardless of the question of same-sex marriage, a "medical power of attorney" should be in place. They are not called the same thing in every state. In SC, for instance, it's called a "Durable Power of Attorney.". . Even for straight people, this can be a good thing. For married couples, there is no question that the spouse is "next of kin." For unmarried people, it gets a little (or a lot) crazy deciding just who has the power to make decisions. Especially in the case of emergencies.. . I have a durable power of attorney, designating exactly which of my friends (I'm single) have the right to make critical decisions should I be incapacitated. I also have their name in my cel phone prefixed with "ICE" (In Case of Emergency) to help medical / rescue workers locate them if the worst happens.. . I have a Living Will, which lays out my wishes should the worst occur.. . And I have a Will, which lays out my wishes should I expire.. . These are not just gay issues, they are issues for everyone. In the case of gay people not legally able to marry, they become more critical, but I recommend everyone (gay or straight, and especially those not legally married) follow these steps. They can save people a world of trouble!. . Oh, one last thought: A joint checking account can also be extremely helpful.. . My dad died in 1993, and my mom in 2009. All these things were in place, and they helped no end!.
