• David Shorr serves as partner in charge of Lathrop & Gage's Jefferson City and Columbia, Mo. offices. Mr. Shorr is a past director of the Missouri Department of Natural Resources, the State of Missouri's environmental protection, state parks, and natural resources agency. He served on the cabinet of Missouri's late Governor Mel Carnahan as well as Missouri Director of Environmental Quality for former Attorney General John Ashcroft when he was the governor of Missouri.

  Currently, Mr. Shorr represents clients in regulatory matters in the environmental, energy, and utilities arenas and handles complex cases involving the scope of legal authority and government public policy. He is a noted authority on water, wastewater, air and solid waste issues, including ecological impacts of the Missouri River basin, the National Environmental Policy Act (NEPA), the Clean Water Act, the Clean Air Act, and the Endangered Species Act. In addition, Mr. Shorr is a registered Missouri lobbyist and assists clients with legislative strategies.

  Before his tenure with the Department of Natural Resources, Mr. Shorr served as assistant general counsel for the Northeast Ohio Regional Sewer District which is the wastewater treatment agency for the greater Cleveland, Ohio region. He provided representation in all areas of the law, including environmental, labor, real estate, public law, administrative and collection matters. He also has experience as an environmental consultant with engineer firms, where he designed regional water and wastewater programs for municipal corporations and environmental strategies for developing subdivisions.

I want to change my name in general because of how scrutinized I have been because of the name. I have came across a lot of ignorant people thinking I'm muslim because of this name and which I am christian. I get a bit of a hard time because of my name. I will say, though the typical muslim scrutiny isn't always true, I have an unbelievably intimidating muslim family. I hope god can forgive me for saying that . But I really want to get away from these people as well. The scary part is that they have friends in law enforcement as well as within the social security administration. Any thoughts or legit advice on how to make this happen ? Needless to say, I want to state, I want to do this the LEGIT way. Not anything illegal. However, I want to be protected. These people are obviously scary in a sense or I wouldn't be honestly stating that..

This is a very sad situation, and you have my heartfelt sympathy for all your pain and trouble. It's unbelievable that your grandson's parents are too busy tearing each other apart to care that their son needs their quiet, loving support and attention for the time he has left, without being disturbed by their animosities towards each other and you.. . As for your question, it isn't clear from the facts who has POA just now. Did your grandson sign the POA document? If he didsn't, then his father still has POA. I'm assuming the new POA is signed.. . Since the new POA was prepared by a lawyer, I assume it contained language revoking the old POA. The father should also have been sent a formal notice in writing that the POA he had was revoked.. . If a doctor (I stress "doctor") at the facility believes your grandson didn't have the mental capacity to sign a new POA, then his father will have to get an emergency order from a court to vacate your POA and revive his old one. Until someone proves your grandson didn't and couldn't know what he was doing when he signed the POA naming you, the POA is good. A healthcare facility does not have the power or the knowledge to decide if a person is legally (again I stress "legally") competent. It's not necessarily the same thing as medically competent.. . Ask the lawyer to contact the facility and tell them they must abide by your grandson's new POA until and unless a court (stress that word again, "court") says otherwise. They are bound by law to abide by the decisions of the appointed person. In this case, you.. . You are correct that now that your grandson can't make decisions for himself, you must make the best decisions you can, according to what you know or believe he would have chosen for himself, and with the advice of the doctor for his comfort.. . Yes, the hospice should be keeping you informed of anything related to your grandson, because you are acting on his behalf and are legally required to protect his interests.. . You have no power to give up the POA to your daughter or son-in-law or anybody else, even if you wanted to. Only your grandson could make that decision. A court would have to appoint somebody to take your place, and it may decide to appoint a complete stranger.
