    ·???????? Reversed a decision on class certification in the Ohio District Court of Appeals for the Twelfth District on behalf of a salt company. The plaintiffs filed a motion for class certification, alleging suffered damages from using and consuming contaminated water from a municipality's public water system and that the contamination was caused by improper storage of road salt by a company that stores road de-icing salt, our client and another co-defendant. The appellate court found in favor of our client, reversing and vacating the trial court's finding of class certification. Specifically, the Twelfth District found that the trial court abused its discretion when it failed to provide factual analysis for dismissing the majority of arguments made by our client and a co-defendant.

Obtained summary judgment for a pharmacy technology company in a Family and Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), and Title VII case in U.S. District Court for the District of Kansas. The 10th U.S. Circuit Court of Appeals affirmed the decision. The case was covered in the September 9, 2011, edition of the Daily Labor Report, a nationally recognized source of news on key labor issues and developments.

    ·???????? Represented a large sterling silver jewelry company in a dispute against a former executive who violated her noncompete agreement by going to work for a direct competitor. Lathrop & Gage sought a declaratory judgment action in Johnson County (Kansas) District Court against the individual, and a date was set for trial. Meanwhile, it was learned that the former executive was sharing pricing strategies and other proprietary information with the competitor. On the eve of trial, the former executive agreed to a new noncompete agreement that would keep her out of the jewelry market for another year.

    ·???????? Obtained summary judgment on behalf of a variety store chain based in the Midwest and Southwest United States in an age discrimination case. The court ruled that our client did not engage in age discrimination when it terminated two of the highest paid executives along with a number of other individuals as part of a reduction in force, nor did it breach its employment contracts with these individuals when it refused to pay certain expenses that were not earned prior to the executives' termination.
