Specified in the will is that a relative may become the live in caregiver and as compensation he/she would not have to pay rent. My question is, is this a valid will since there is no mention of any ownership change after the mother dies? Can it just stay in her name after she dies until her handicapped son dies? There is a loan on the house too, by the way. This is being done to protect the son, so he may continue to receive government benefits, but I think it's not valid.. If she leaves it to her son, then his governmental benefits will cease until his assets run out. His son who created the will is too cheap to hire an attorney.. I meant to say her son, who is the handicapped son's brother, is creating this will on his own based on her wishes, but obviously he doesn't know what he's doing..
