  • Mr. De Haan was born in Grand Rapids and is a lifelong resident of West Michigan. He is married to Debra and they have two adult children - Kelsey and Nathan. When Mr. De Haan is not working he enjoys spending time with his family, getting involved with his church, mountain biking, backpacking, playing racquetball, and doing volunteer work. Yes he can sell it for you. This issue is with the title. If the bank is holding the title, obviously you cannot sign it ahead of time. If you are in possession of the title, you can sign on the Sellers portion and have it notarized if required in your state, and leave it with your brother. If the bank holds the title, your brother should inform the buyer that the bank is currently holding the title and after payment is rendered and the bank releases the title, he will have to send it to you to sign in India. This of course is going to take time so that's why you should inform the seller so there are no surprises or worry due to anticipation. Your brother just cannot sign the title for you, that is illegal. However, you could create what is called a limited power of attorney. This is a simple document that you can create yourself. You simply write that you are giving your brother power of attorney for a set amount of time, and that he can act on your behalf in regards to the sale of your automobile. You will need to sign it in the presence of a notary for it to be official. You can look up examples of Power of Attorney on line and use it as a sample. Just be sure to place a cut off time like 12/31/2009 at Midnight, and limit what powers he has such as he can only act on your behalf in regards to the sale of your car and list the Vin number of the car. Also include a clause that the Power of Attorney can be revoked by you at any time. This will solve your problem legally, and if you word it correctly protect your interests. If a willing buyer comes along, all he needs to do is let the buyer know that the bank holds the title, and that he will forward it to them as soon as the bank releases it. When he gets the title, he simply signs your name, not his, and forwards it on to the buyer. If any legal questions arise, he can present the Power of Attorney to show that he acted legally on your behalf and did not commit fraud.
