ALL contact with the bank needs to be in writing, so you can show it in court if you have to. Although it doesn't sound like it would, using the post can actually speed up your claim!. . When you talk to a the bank in person, they can tell you they will do something, you give them the time allowed to do it, and then find they`ve done absolutely nothing! You then have no recourse, as there is no way of proving what they said to you.. . Keeping everything in writing makes it official, and means they have to stick to the relevant time limits.. . Unlike other things, you are not engaging in a dialogue with the bank (at least until you file a court claim). You ignore what the bank say to you (as you will only get standard responses fobbing you off that they send to everyone), and keep working through the deadlines. You send the first letter asking for your charges back, wait 14 days, then send the "Letter before Action" giving them a last chance before you file a claim, wait 14 days, then file the claim in court.. . The only time you stop the process is if they make you an offer you are happy with (which hardly ever happens before you file the claim in court).
