All you can do is either change her name by deed poll or by statutory declaration.. When I divorced my sons father, my son did not want his surname, he wanted to change it to mine. I made him think about it when emotions had settled down and 9 months later he still wanted to change his name. We went to a solicitor who drew up some papers that I as my sons mother had to agree to the change of name as well as my 9 year old son. We then got some paperwork legally signed saying from that day forward my son would use the surname............and not ................ The piece of paper had to be stapled to his birth certificate which it is to this day..
