  • Melinda L. VanLowe received her Bachelor of Arts Degree in Government from the University of Virginia. After working for two years as a paralegal with Skadden Arps State Meagher & Flom, LLP, she then earned her Juris Doctor Degree from American University Washington College of Law. Melinda served as a law clerk to the Honorable Dennis J. Smith, now Chief Judge of the Fairfax County Circuit Court. There is no statute in New York that governs Living Wills. The highest court in New York has held that a Living Will is valid as long as it constitutes ?clear and convincing evidence? of your wishes.. 2. There is no standard form for a Living Will in New York which is interpreted in a uniform way. This means that even a well drafted Living Will is ultimately subject to interpretation by those who need to determine your wishes.. 3. It is hard to draft a Living Will that provides specific instructions with regard to all possible future events. This means that inevitably, a Living Will will require those responsible for your care to interpret general instructions in your Living Will in the context of specific circumstances.. . If there is someone you trust to make health care decisions for you if you are not capable of making them for yourself, you should consider using a Health Care Proxy. In New York, by statute, the person you name as your health care agent in a Health Care Proxy can be given broad powers to make health care decisions for you. These decisions can include decisions necessary to help you regain your health. They can also include decisions concerning the termination of life support. I am from germany and we have government health care there in competition with private health insurance companies. One problem that we see a lot is that people from private insurances are treated with favor. . Examples: They get taken into the rooms quicker and get better medication. Also some private insurances pay for procedures that would not be paid for by government insurance because of numbers if the successrate is unclear or lower than lets say 30% (thats a guess) or the procedure needs to be done outside the country, the government insurance does not pay for it. Leaving many people behind that would have a (small) chance of being cured and their hopes get killed.. . Also the average german pays about 54% of their brutto income in taxes and social benefit programs. If you think this health care plan wont affect your wallet you are wrong.. . And these are things that happen while there is still competative health care available.
