  • Attorney Americo S. Ventura founded the law firm of Ventura, Ribeiro & Smith in 1957. He was recently honored by the Connecticut Bar Association for 50 years of service in the legal field. He was also honored by the Portuguese Bar Association of CT for his 50 Years of Service to the Community, where he was presented with a Proclamation by Connecticut Attorney General Richard Blumenthal. Attorney Ventura was one of the founding members of the Portuguese Bar Association of CT and currently holds the position of President.

    Attorney Ventura was born in Danbury, CT to Portuguese immigrants coming from the Northeastern part of Portugal. Many people own property jointly as husband and wife. In such a situation, most assets pass to the surviving spouse by operation of law upon the death of the first spouse. In all probability, he may not have had a probate estate.. . Also, consider that if he was in a nursing home, his care would have been quite expensive. I would not be surprised if it cost more than $100,000 a year.. . Now, your question is how to start. I agree with "winzip" -- find out what county he lived in and either hire an attorney to check records in the Register of Wills office to see if there actually was an estate administration. Even if he died in Texas, you should start with the county of his regular residence before going to the county where he died. You would be interested in seeing a copy of the will and an estate inventory, as well as any accounting or inheritance tax returns that may indicate whether his estate had to pay for a lot of un-reimbursed medical or nursing home expenses. If you want to do some of the work yourself, you could telephone the Register of Wills office to determine if there actually was an estate administration. If so, they may help you look at the estate documents, and they could provide you with copies at a nominal expense.

There is no process in the UK. The wife can either take the husband's name or not,. If she does then she simply starts using it.. . But therer is no law in the UK for names. You can start calling yourself anything you like at anytime.. . The only legal thing some people like to do is get it changed on the legal records but even then their original name will always be recorded as well, and they can never change a birth certificate.
