  • Richard Travis, Managing Partner, has been practicing law for over 12 years. He began practicing in a small Boston firm and then joined the Army's Judge Advocate General's Corp (JAG). How do I handle this Power of Attorney situation?

Firstly, I will discuss about the bilateral contact. An example of this type of contract is Thornton v. Shoe Lane Parking in which a professional musician, Francis Thornton, had a job for a day playing his trumpet for the BBC at Farringdon Hall in central London. The plaintiff decided to leave his car nearby in a recently opened multi-storey car park in Shoe Lane close to Fleet Street. He drove up, pressed a button and received a ticket, at which point the barrier rose up and he and his car entered the car park. A lift took his car to an upper floor. Three hours later the plaintiff returned from his appointment. The car was brought down again on the lift to the place where Thornton was waiting, but as he was loading some items into the boot of his car, an accident occurred. Part of the blame for the accident lay with himself and part with the car park as a result of negligence by one of the attendants. Mr. Thornton sued Shoe Lane Parking Ltd for his own personal injuries and damage to his car. The Court of Appeal eventually awarded him $3,637 for his injuries (he had been 50% contributorily negligent), buy nothing for the car. It was held that a contract had been formed as soon as he passed the ticket barrier, there being offer and acceptance and, therefore agreement. The contract formed was bilateral in that the plaintiff had promised to pay in return for the defendants looking after his car. Because this was a bilateral contract, both parties were bound contemporaneously.

While it does not take a lot of space, it DOES take a lot of expertise. For people to be able to reach the web site, it means that you have to keep your computer run 24 hours a day 7 days a week 365 a year. Something most people can not do with only one computer. Usually a web site is hosted on two computers so that if one goes down, the other takes over.. . That, of course, means having two cable or DSL lines running into your house (twice the Internet bill every month).. . Most ISPs limit that amount of traffic you can have every month. It is usually not enough to host a web site, so it means having to pay for extra usage. That is if the ISP will even LET you host a site. Most will not.. . If you want to be able to collect payments (credit cards), you will need a merchant's account. Those run about $300 a month. Plus fees for "charge backs" - should someone cancel their order. And the possibility of law suites should a customer not be satisfied.. . Having hosted sites before, I would strongly caution you against doing it. It is NOT something that the average person can do from home.. . Instead, do a Google search for "hosting services". You will find many cheap (and even free) hosting services where you can set up your site, and have someone else handle the 24/7/365, the law suites, the merchant accounts, etc. Often you will get free applications (e-mail accounts, form submits, form validation, etc.) that if you had to purchase them could run into hundreds of dollars. Often they will include a "wizard" and templates to help you set up the initial site.. . It is much smarter then trying to host the web site yourself.
