Instructions. . 1. . Obtain the legal name change documents. You can secure the proper forms from your county's Superior Court. Visit the Court's website to determine if the form is available for download. The packet of documents will include a general set of instructions, details of where to obtain a criminal record check at the Court, a name change petition template, a form to be used as a notice of your intent and two affidavit of character forms.. 2. . Post the notice of intent. To complete the name change, you are required to post a public notice indicating your intentions. Complete the notice change form and have it date stamped by the office indicated on your general set of instructions. Your instructions or the county clerk will also tell you where to post the notice. The notice must appear publicly for at least 10 calendar days.. 3. . Request a criminal background check. This is required to ensure that you are not changing your name to avoid the law or legal penalties for which you are responsible. If the name change is for a child less than 16 years old, a criminal background check is not required.. 4. . Obtain notarized affidavits of character. Complete the necessary portions of the affidavits in your name change packet and then provide the form to two other people. The individuals who vouch for your good character cannot be family members. The form must be notarized by a Notary Public.. 5. . Submit the necessary forms. Schedule a time to visit the county clerk to deliver your petition to change your name and the notarized affidavits. Once your forms are reviewed by the clerk, you will be given an Order and Certificate of Name Change to complete during the visit and pay applicable fees. If the county clerk accepts your petition, you will be issued a certificate stating the name change in the mail.
