Here's the deal:. . There is a chain of custody on the urine sample. What this means is someone has to sign for the urine sample every time it changes hands. That's one thing your lawyer is going to look at, and if there are any discrepancies that would indicate the chain of custody procedure was not followed perfectly to the letter, your lawyer will point that out to the judge. If the judge agrees that there's a problem with the chain of custody, the case could be dismissed.. . Every lab is different in terms of workload, so it's difficult to say how long it's going to take for the urine sample to be tested. Nowadays they test urine using the GC/MS (gas chromatography -- mass spectrometry) machine, and it's VERY accurate. Your lawyer will need to look at the urinalysis results carefully as well. If the paperwork shows that a re-test had to be performed, your lawyer could argue your urine sample was not properly handled.. . The bottom line is this: In order for the court to find you guilty, the judge has to rule that: (1) The chain of custody for your urine sample was properly followed, (2) The urine sample was properly tested, and (3) The test results clearly show that your BAC was above the legal limit. I find it hard to believe that someone who had only two drinks would show a BAC over the legal limit 3 1/2 hours later, so I'm betting if the test results come back and you're under the limit they'll drop the charge.
