  • Heather O'Shea's practice focuses on health care fraud and abuse litigation and regulatory and compliance counseling. She represents clients throughout the health care industry on regulatory and compliance matters involving Medicare and Medicaid, including the Anti-Kickback Statute, the Stark Law, reimbursement regulations, and FDA advertising and promotional guidelines. She defends clients under federal and state fraud and abuse laws and the False Claims Act. She has significant experience conducting internal investigations, representing clients in voluntary disclosures, and advising on refunds to Medicare. Heather also has extensive experience advising clients on compliance program development, implementation, and conducting assessments of existing compliance programs.

    Heather's representations include defending The Christ Hospital in a novel False Claims Act case brought by the Department of Justice, in which the government alleged that the manner the hospital staffed its reading panel for noninterventional cardiology tests was in violation of the Anti-Kickback Statute; advising a client on a multimillion dollar repayment to the Medicare program; and defending Lafayette General Medical Center in a False Claims Act case brought by the Department of Justice, in which the government alleged medically unnecessary procedures were performed by a physician on the medical staff. Heather also was part of the Jones Day team that advised Abbott Laboratories in its $2.8 billion acquisition of Advanced Medical Optics, Inc.

    Heather is a vice chair for the American Health Lawyers Association Fraud and Abuse Practice Group. She is also a member of the American Bar Association and the Illinois Association of Healthcare Attorneys.
