There are two separate issues.. . First, can you prevent the information obtained by the deception from being used against your daughter? Possibly. In most jurisdictions, information or evidence obtained in violation of the attorney-client privilege is inadmissible as a matter of public policy -- particularly, where, as here, the information was acquired by deception. Your daughter's NEW attorney (I assume she is firing the boob that revealed the information) should seek to have the information excluded from evidence.. . Second, after firing the attorney, your daughter should demand her money back, and possibly sue him/her for malpractice and breach of fiduciary duty. If the facts are as outrageous as you relate, the attorney will probably voluntarily give the money back. Whether your daughter wants to go further is up to her.
