i've been using my business name in general for he last 5 years or so. i've been using while doing business just within the last two years. i hadn't filed for trademark so far because i just couldn't afford it. when i ran a search for my company name on the USPTO website, it came up with one trademark waiting on approval for a very similar name. it went up for public dispute on october 26th, and will be up for dispute for 30 days from that date. is there anything i can do to stop their petition for trademark from being approved? for instance, if i can prove that i've been using the name and doing business under the name for longer than the applicant on file, will i take the greater claim?.

I know what power of attorney is but how do I use it? Our friend has our old VW at his home in Louisiana where we recently moved from. We now live in NC and need the money so we want to sell the car. We have found a possible buyer that is a local in LA and he going to look tomorrow. If he wants to buy we will need to give power of attorney to our friend to sign the title over to him. So how to we give our friend power of attorney? Are there froms? Will we need to fax them to a notary in louisiana? Does he just sign the title over? What do we do? Other clauses a contract can include. I typically include more than the bare minimum when composing a contract, but to avoid making the contract too large and overwhelming, I try not to get out of control.. Confidentiality. Although the word is a bit "covert" sounding, it fits this part of the contract. I always include something that says I'll keep the clients business practices to myself and the client will do the same.. . Non-Competition. This goes along with the confidentiality agreement. This clause says that the freelancer and the client will not steal work away from each other. In order for the freelancer to get to work, the client needs to get him the actual content for the site. The client never comes through with the content for whatever reason. Finally, seven months later, the client turns in his content and expects the freelancer to get right to work. Sound exaggerated? That is a story out my own experience.. . To prevent this situation, an agreement timeout is needed. If the client is late at a specified amount of time, then a late fee shall apply. If the client is even later and doesn't pay the late fee, the contract becomes null and void.
