After getting married, I didn't change my name and wanted to know how to do it now. . Also, my sister is about to be naturalized for her citizenship and wanted to know how too. . We're both living in Santa Clara county, CA. We asked the recorded clerk office and got the run-around so i'm still clueless. . Thanks all for your answers..

What I would recommend in your case is to have a simple memorandum of agreement w/ the lawyer you intend to hire indicating a percentage (w/c you and your family will have to decide upon) of the estate's value as his professional fee. I would think 20% of this percentage could be his initial payment and balance payable upon completion of the entire work. It's a simple legal form w/c the lawyer of your choice could prepare or even you could do it. You could get a book on legal forms and presto! Just make sure you read closely the contents of the memorandum of agreement if cited lawyer were to prepare it.. . You could probably ask around (say in reputable universities w/ fresh graduates who have just been sworn in as full-pledged lawyers) who are the bright and honest ones. Law professors could be a good source because they know their students and would only be too happy to help them start out in their profession. Since these new lawyers are young and idealistic and all enthusiastic, you may have a good chance of getting a much better deal than having to contend w/ the elderly "pirates" who don't usually do their homework and charge exhorbitant fees.. You even have the luxury of interviewing these young people and choosing the one you think is best!. . You can catch the professors in the faculty rooms or get a listing from the university's information center and casually ask who among them are good and reliable.. . Good luck and God bless!

Depends on what state you're moving to. If the state recognizes SSM, you should be fine. If you move to a state that doesn't recognize SSM, there still may be a loophole:. 1. Go down to social security office with your marriage license, your photo ID (Drivers License, passport, state ID card) & the SS-5 form completed (link is below in sources). 2. After you get the new social security card in the mail (ater 4-6wks), go down to DMV with your new social security card & marriage license for a name change on your state ID/Drivers License. 3. Go to the businesses you do transactions with & update your name on all of your accounts (bills, student loans, bank, utilities, etc). 4. As an added precaution, I'd say get a passport done as well in your married name. The state department now accepts a marriage license for name verification, as well as social security number.. . That's what the wife & I did., & it took us about 4months from when we statred to do the 1st 2 steps. Everything else was a cinch. I thought that social security would give us a hard time about the marriage license since it was SSM. They just made sure it was a certified document from the state, & that was that. We got married in CA & saw the info about going thru the courts for a name change. However, we bypassed it by going thu social security DMV. If in doubt, check with the state & ask them about name change with updated social security card & DL b/c of marriage.. . The only problem you MAY run into is if someone at social security office or DMV gives you hassle about the marriage license. But you're not asking your state to recognize the MARRIAGE, but the name change.. . Good luck!
