The Social Worker keeps telling my husband he has to make the decision as to where she is going, as he is listed as her healthcare POA. However, she is fully alert and apparantly capable of making her own decisions --- has not been declared incompetent in writing by her MD (which my husband has requested before he will step in as a POA).

If you get a power of attorney, you'll have to talk to a lawyer, and he will be able to give you a valid answer. The only POA problems I've ever had have been from Texas, where they must be very specific.. . As for the second question, is your father incompetent? If not, why should you be able to prevent him from accessing his own funds? If one of my sons tried that, I'd disinherit him.
