Without a will everything that belonged to the father goes into probate. Your granddaughters will probably have to hire an attorney in Montana (this is where the father lived, I presume?) to help them with petitioning the court for possession of his belongings. If there are no outstanding debts placed on the estate from a hospital or other institution, and no other petitioners to the court (usually pesky relatives who claim they had a close relationship to the deceased) this can take a year, sometimes longer if the attorney has trouble rounding up the necessary records for ownership of the vehicles and other property.. . You didn't say if the vehicles were owned free and clear by the father, or if he was making loan payments on them to a bank or lending company. If that is the case, the bank can take possession of the vehicles unless the granddaughters call and assume responsibility for the loan. This can be relatively simple or maddeningly confusing, depending on the banking laws in Montana.

I paid my attorney on June 9th to file a very simple uncontested divorce. (It now has been 3 months since I paid him) After nothing being filed after 2 months, with the advice of the SC Bar, I sent him a certified letter dismissing him as my attorney and requesting that he return my money. Sent them to my spouse and already recieved the "green card" back from the PO. On Sept 2, I get a call from this attorney stating that he filed my paper that day. Question is...............How did he file these papers without my signature on anything? How was he able to file a duplicate divorce? Does he need my signature to file? What can I do now? I told him that I already contact the Bar about this and he laughed at me and said they are not going to do anything. And also told me that I was very bossy and that is why my husband left me. You'll need to change your name on the title first. Before you can sell the car you have to sign the title and your signature needs to be notarized so you can't sign in your former last name if you identification card shows your new last name. I don't see you getting into any trouble at the DMV. Just take the original title, a copy of your marriage cert/divorce decree or whatever legal document you may have showing your new last name and request a new title. They can usually print the title there at the DMV. Then you can sign the title and have your signature notarized and sell the car
