I'm a small business owner myself, so I know quite a bit about it. I started a patent law firm about 2 years ago and make very good money now practicing patent law.. . The first question you need to answer is what is your business going to do? "Going into business" implies going into a specific type of business. It all revolves around what you can create, market, and sell.. . You really need one of three things to start a successful business: (i) a lot of capital, (ii) a unique or high demand, marketable skill, or (iii) a really great, new idea.. . (i) If you have a lot of capital, you can just buy into a successful, established franchise, like McDonald's. There is normally not as much risk in these business ventures as the business is already established and generally you won't buy into a failing business, but they can still nevertheless always fail. I assume if you're only 17, you don't really have the kind of capital I'm talking about, so I'll move on.. . (ii) Your skill can be anything from patent law (me) to mowing lawns. So long as people are willing to pay for it and you can be the one to fill that service, you can get clients and make a living. Remember, there has to be a high enough demand for your skill to support yourself. Also note, no matter how good you are, you're not going to win every client, so there has to be enough demand for you to support yourself without completely controlling the market yourself. At your age, a service based business is your best bet. You could start a business to walk pets, or clean houses... whatever. Just make sure people want your services and will pay for them.. . (iii) These are the business that outright fail or make millions. Unique ideas to create new markets often have high rewards if the market is robust. However, outside of the realm of being a scientist or otherwise just having a mind shattering idea, ignore these start ups.. . So, the first thing you need to do is draw up a business plan. Consider what type of business you're going to start (likely service based). Come up with a list of services and fees to provide those services. Figure out what your expenses will be and what your profits will be each time you perform your service. Figure out how much you will have to sell to make comfortable living. Do you think you can actually sell that much? You probably will not be able to hire anyone for your first several years in business, so can you sell enough and still have the time to perform your service? If the answer is no, that business plan fails. Keep looking for a better business idea. If the answer is yes, then you can start to think about the legal aspects of starting the business.. . When you first start, you can work under your own name with no problems. There are legal consequences though to these so-called sole proprietorship. Your business name is your name. If you don't establish a company/corporate shield, then you are personally liable for any debts of the business.. . Eventually, you'll want to talk to your state corporation commission (or equivalent in your state) and fill out the paperwork to start a legal business. I would suggest staying away from a corporation unless you have a strong legal reason to do so. There are many formalities you must adhere to. Stick with an LLC. It's much easier to manage for a first-time business owner without a training in business or the law. Write your articles of organization and bilaws (look online to get samples), which is an agreement the owners of the company agree to adhere to. Then register with the IRS to get a EIN, which is like a social security number for businesses. Once you have your EIN (you get it immediately when you register your business to the IRS online), then you have everything you need to open a bank account in your business's name. You'll still have to guarantee the business at this point. You can go ahead and order checks and business cards now. You can hire someone online to design a logo. Then check your country/city clerks office to see if you have to register your business with them to legally do business. The last step is filing your DBA forms (doing business as) that let you call your business whatever you want without the "LLC" at the end, or another fictitious name. This isn't necessary, but it can make marketing materials (pamphlets and business cards) look cleaner and more friendly because you legally don't have to use the LLC now.. . Congrats, you now have a business. Just remember come tax time, you can expect to pay $600 minimum to an accountant to prepare your taxes including your schedule C. Don't try to do it yourself your first time. You'll screw it up and get audited.. . Good luck.
