    Ms. Marks began her career in health care. During her undergraduate education she worked as a nursing assistant attending to the needs of her elderly patients. After graduating from the University of Wisconsin at Eau Claire, she became a nursing home administrator. Ms. Marks worked as the executive director of Midwest Orthopedic Network LLC, where she managed a network of over 120 orthopedic physicians. Ms. Marks has held various executive positions and worked for some of the largest hospitals, physician groups and health plans in the area. Most recently, Ms. Marks worked at CCH Incorporated as an editor where she analyzed the health law in the areas of Medicare, HIPAA, OIG, false claims/qui tam, anti-trust and stark provisions.

There is an exception. If you can prove that you were demoted for an illegal purpose (race discrimanation, or age (old age only, discrimination due to youth not an exception), national origin, gender, sexual orientation (in some states), then you might have a basis for objecting or, at minimum, you would have a claim at law. But in the absence of illegal discrimination, the employer can demote you for any reason -- or no reason at all.. . Just as an example. If the employer does not like blue eyes -- and you have blue eyes -- he can fire you. It might be stupid, but its his company and he can do what he wants. He might lose business and have a hard time attracting employees, but he has that right.. . If you were demoted due to a disability, you might also have a claim.. . ASSUMING that you do not have a LEGAL claim of discrimination, the real question is .... what can you do.. . There are two tacks. Either way, you start with the employee manual. Find out what the company says your rights are. Remember, the employee manual will almost certainly say something to the effect that the company can change any rules it wants any time it wants, and that the manual is not a contract. However, most businesses try to follow the manual, and it is important for you to know your rights.. . Next, you can decide whether to "fight" or "win.". . If you decide to "fight," you must be on really strong footing with the company manual, and you must understand that, legally, the company can fire you for any reason or no reason at all. This means, you are risking your job. On the other hand, if you were given an employee, it could (don't count on it) be viewed as showing initiative. You should go to the HR person, in a meeting with the current manager and VP, and show why (a) you were the right person for the promotion
