Expect a lot of testimony that can't be proven. "He said ...." and "I never said ..." stuff. (Think Judge Judy.) What will really count are facts that the judge can see- the contract, the description of the vehicle *in* the contract, etc. Seems as though you have a case, but you have to be able to prove each fact. The judge has seen a lot of stories, and anything with a signature counts a lot more than someone's biased testimony. (Yours is as biased as the sellers. That doesn't mean you're a bad person, nor the seller is a bad person. Just that both of you are biased in this regard.) .... Take care!!

I have a major problem, please help......I signed a contract w/a real estate agent that I knew, however she did not fill in the date, but said as long as I gave her a 2 week notice, I knew it wasn't wise, but I didn't want 2 seem untrustworthy & I did feel I would stick w/her, because I did trust her, however I didn't know her @ all, she is not listing or taking pics the way I thk she should & I brought this 2 her attention & asked her 2 do it differently & she told me 2 "trust her", we r in the prime selling season, she will not take a pic of the beautiful updated large oak bathroom vanity & mirror w/pergo flooring that is off of the spacious 15 X 19 Master bedroom that has brand new hunter green carpet that I jst laid down, with newer windows & matching hunter green mini blinds, no pic of the 2nd bedroom w/new flooring as well & newer windows, no pic of the foyer w/a real tile floor & real partially bricked wall, instead she keeps in the pic of the crudy part of the basement that I told her I want removed, takes 2 pics of the new living room carpet that she picked out & took out the old pic that showed the open floor plan in this rather small house, which showed the foyer, instead she shows the grassy back yard, instead she shows the dirty deck, instead she takes 2 pics of the front of the house & leaves the recycable & yard waste containers in front of the brick that goes partially up the house, these r green & blue apprx. 4' each high containers (not inviting).....I said if u only have 8 pics I wanted 2 b sure & get the master bedroom & bathroom, delete basement, I explained when I'm looking I want 2 c the inside & if they don't have pics up of the inside I'm going 2 move on, if u only have 8 pics she needed 2 utilize those on the finests selling points inside & of course u need a front view of the house, (preferably without objects) & she didn't listen @ all & basically made it worst, because now u can't c the open floor plan or the foyer, I told her I wanted her to mention the 2005 central air that I put in, but she didn't or the 2001 furnace & water heater, updated kitchen & bathroom, all of those are good selling points, all of which I told her, instead she mentions there is room to build a garage, please point out what I DO have rather than what I don't have, take pics of all the good, not the very worst crudy part in the basement.....I want her out of here now, but verbally she said 2 weeks, legally there was no date when I signed the papers.......she does work 4 a reputable real estate company, if that helps, I jst signed June 1st, but I,ve had house 4 sell for about 10 months, I need 2 move it now, also she said she could sell it in a month, it's been a month, she wanted me 2 prof. clean a carpet, I did that, not good enough, so she wanted me 2 replace, so I did, then she wanted me 2 buy used frig, so I did, I keep doing what she advises me 2 do that costs me money, why can't she do what I ask her 2 do, isn't she working 4 me, but she isn't listening, yet I signed an undated contract ....help me, please!!!. To Cactusge....Thank u sooooo much 4 taking the time to provide such useful information & advice....sorry about my writting, I do know when to be professional, I just get so used to doing that when I email....I am from Iowa, my main concern is her filling in that blank spot, I don't have a copy of the contract, we had met for lunch, so of course she didn't run me copies, now I'm fearful that she has or will fill that in to what ever date she wants, which means she could have me in a signed contract for a year, because my signature is on it.....I knew better & I still can't believe I did it, but I can't dwell on that part it's over & done I just need to see where I can go from here......thank you again, I truly appreciate your help!!!!. . To your take on it....u r right, I did ramble & u had some valid points as well, I'm sorry u felt I was "bragging", I'm not a bragger....it's what I thought was "positive selling points".... Btw, she hasn't had ANY open houses & hasn't said anything about having any either, also yesterday I went to pull it up on there company site where I enter the mls # & it wouldn't come up, however if I went to her the listing agent it was listed there through her, could anyone tell me why, I know what I'm suspecting, but I may b wrong, so please tell me why.....I emailed her about it & her reply was "what....it certainly was" & then sent it, I went back to the very same site, did the identical same thing....entered my mls # on there company site & this time it brought it right up, of course this was after I told her it was not there & I had tried pulling it up by address, taking out ave, taking out th, I tried everything to pull it up w/my mls # prior to contacting her & I could not pull it up....is there anyway to find out if it had been listed on MLS from June 1st up to July 4th??? Thanks sooooo much in advance & to everyone for all your help!!!!.
