  • Bryan Davis is a native of Atlanta, Georgia. He relocated to New Mexico in 1996 and earned his B.A. in History, summa cum laude, and J.D., cum laude, from the University of New Mexico.

Bryan has achieved the highest rating for ethical and legal abilities, AV, by Martindale-Hubbell, based on peer, judge, and client reviews. He is also a Southwest Super Lawyer Rising Star in Healthcare law for 2012 and 2013, and the only New Mexico lawyer to obtain this honor.

Bryan dedicates much of his time to healthcare litigation. He has represented numerous hospitals, nursing homes, assisted living facilities, health plans, payors, and Medicare/Medicaid providers in complex fraud, RICO, antitrust, False Claims Act, New Mexico Medicaid Fraud Act, ERISA, negligent credentialing, and unfair trade practice cases for the past decade. Practice highlights in the healthcare arena include defending providers in False Claims Act investigations by the Department of Justice and whistleblower litigation, obtaining dismissal of a putative $82 million antitrust claim brought by a physician against a hospital for malicious peer review (Singh v. LifePoint Hospitals, Inc., 536 F. Supp 2d 1234 (D.N.M. 2008)), obtaining summary judgment for a hospital against Unfair Practices Act, fraud, and breach of contract claims challenging the manner in which a hospital set charges for emergency department services rendered to the uninsured, and most recently obtaining dismissal of a putative $17,000,000 Medicaid Fraud Act claim brought by the New Mexico Attorney General Medicaid Fraud Unit against a provider of in-home assisted care services to Medicaid beneficiaries.

Bryan focuses much of his practice on investigating and prosecuting qui tam and retaliation cases for whistleblowers who expose fraud on the government in the healthcare and government contractor arenas under the federal False Claims Act, New Mexico Fraud Against Taxpayers Act, and New Mexico Whistleblower Protection Act. In January 2013, Bryan was co-counsel for a plaintiff in the first trial under the New Mexico Whistleblower Protection Act, in which they obtained a verdict in excess of $710,000 against the New Mexico Public Regulation Commission: http://www.sfnewmexican.com/Local%20News/011913whistleblower3#.UdSdv9g8rFw

In October 2013, Bryan and his partner, Chris Lee, tried a complex civil rights claim for an OB/GYN whose privileges were suspended at Gila Regional Medical Center in Silver City, New Mexico. The jury awarded Bryan's client $1,861,644 for lost income, damage to his reputation, and emotional distress: http://www.scsun-news.com/silver

eta. If it was a free trial and you signed up with them but "never" made a payment, the collecting SOL and reporting period would start from the date your first payment was past due.. . eta. For example, if your first payment was due 10/15/01 and you failed to make "any" payments, your SOL and credit reporting start date would be 11/15/01

As an aside, I received an email from a recruiter friend today, that included recommendations regarding 'Resume Guidelines', 'Constructing a Resume', and a list of 200 action verbs, as well as a sample Cover Letter
