If a competency hearing is held, the question of competency will be decided by the judge who will consider and weigh the "evidence" presented to the court. In this case that could be testimony regarding the individual, medical reports and/or the person's own statement.

Hi,. . In my previous question I asked for advice on a legal name change. I am now told that I would have to send a letter by certified mail to my creditors informing them that I have applied for a name change. Is there any required special format for this? Should I include a copy of the petition? How can I do this so that the judge is satisfied when I go to my hearing? The coourt is not allowed to give me any advice on this and I can't afford a lawyer. Any help would be appreciated. :).

Sir, you have touched a very sensitive nerve. In Bangladesh mostly cunning and tout types of people study law and then try to solicit 'customer' and earn a fee for passing their 'client' onto some serious and/or senior lawyers who are the real front-man to face the court. This is in violation of the Oath of Advocates (Canons of Professional Conduct & Etiquette) of the Bangladesh Bar Council.. . In our family my late eldest brother was a successful lawyer who died of cancer in August 2008 and there is Gold-Medal Awarded for deserving person or institution who does the best service for th people, the way my bro did the most of the PIL (Public Interest Litigation) which are tantamount to "Nijer Kheye Boner Mosh Tarano", meaning doing some service for others without any benefit for self. I am not boasting about family (bro) but it is true that he was also lawyer for Appellate Division and a very successful but rare type of species among the lawyers community in Bangladesh.. . When I go to Judges Court of the High Court to attend various cases related to our business (ex-agents defalcated money, customer did not pay the outstanding dues, my BIL and ex-partner used government machineries illegally and to cause harm to our company- needed Writ Petition, etc) what I found that these lawyers are very cruel with their clients and they really earn their bread sometimes at the cost of poor peoples' misery when such souls would come to a lawyer for getting justice for the sufferings already done to them, but find that these so-called lawyers suck the last drop of the bloods out of their clients by using various tricks to delay the judgement.. . It is not that all the lawyers in Bangladesh are that bad, but the good lawyers are in the minority. The lawyers may be rightly thinks that they are the most learned person in Bangladesh and people from other professions are inferior to them in terms of intellectual prowess. The standard of lawyers' studies is so low and disgusting that it is easy for a mediocre graduate to enter law-studies and can easily earn the degree as well as Certificate by the Bar Council to conduct business as lawyers in lower courts. The scene in any court in Bangladesh is akin to village market where the lawyers are the merchants and the buyers are haggling with them about this or that fee or money.. . My apology to my late brother who was indeed a different person. And also my younger sister who is also a lawyer and now trying to complete her LLM after about 14 years of practice in both th courts. Btw, this LLM certificate may enable her to get government appointment as Assistant Attorney Generals which are mostly political appointments and my sis is now in the opposition polarity to present government who are nakedly doing nepotism and partisan acts in almost all sphere of government jobs or service or business.. . Edit-. Sir, I have stated it as 'sensitive nerve' since we know how much sensitive these lawyers are about themselves and how selfishly they toe the party-line. The present government made the rule-of-law a mockery and the AL biased lawyers did divide this community into clearly two parts, the way their leader divided Bangladesh into Pro-freedom-fighters (Mukti Juddher Pokkher) and non-freedom-fighters (Mukti Juddher Be-Pokkher). The label gets change accordingly to current loyalty and connections with the party-in-power. It is alleged that the lower court still follows the ruling party's dictate on political cases (Ministry of Home and Ministry of Law). The same allegation is brought against the Justices of the High Court too. Can you see why this is so sensitive issue now? I may be held for 'contempt' for writing such matter here. We are living under semi-Savaki (Iranian secret police) state now.

I am trying to create an educational/informtional DVD for young teen men. in this video i would like to mention that i like various music artist and their songs, sports teams, martial artists, movies, and i would like to repeat some lines from those movies. I will not be useing any logos or actual pictures or actual sound clips of music or any movie clips. i just want to mention them in the DVD, and say that i like them,and that i think they're OK. there may be a swear or two in the DVD also, I'm just trying to avoid any legal problems..

No, I don't. My ex living in Massachusetts was fined for not buying health insurance. He is a Republican, BTW. Fining people only angers them, it doesn't change their minds about it.. . The logical corollary to this is to give people a choice: Buy the kind of health insurance you want from a wide variety of policies and coverages. Or, if you don't want to buy health insurance, the Insurance Commissioner should be able, by law, to force you to have a living will, a prepaid burial plan, and durable power of attorney so that any of your useful organs may be given to those in need. Just like bikers who don't want to wear helmets or drivers who don't want to use seat-belts should have the same such documents signed and filed in case they have an accident while riding helmet-less or driving unbelted.
