Here is my situation. I have a 5 year old daughter & I split with her dad just before she turned 2 years old because he was violent towards me. His name is on her birth certificate. When my daughter was 3 she told me she didn't want to see him or his family anymore & used to get upset when I mentioned about her going there. I have been with my new partner since my daughter just turned 3 & we also have an 11 month old daughter who has my partner's surname. My oldest daughter wants to have the same surname as her sister & I don't know if I would need my ex partner's decision. I will also be chnaging my name by deed poll to my partner's name soon.. . My daughter was born in June 2003 & I heard there is a certain date where I wouldn't need my ex partner's permission.. I have got different answers from different people so I'm quite confused on what to do.. . Thank you in advance.. Forgot to mention, he was forced to make maintenance payments by the Child Support Agency. I had my first payment in May this year & we had been split up 3 years that month. He hasnt seen my daughter since December 2006 but this was wholly her decision.. . I live in Wales, so i'm not sure if the law is different to England, Ireland & Scotland..
