I have a property that I purchased thru a individual to individual sale. The loan was take care of thru an attorney and title company, all legit. The person I was buying the property from has since passed and his son has taken over as executor of the estate. I unfortunately am late this month, so I received a letter from this person requesting a late fee of $50 and if not paid in 15 days another $50 and will continue so on after that. According to the promissory note a late fee of not more than 5% can be charged 10 days after the payment is due. The contract does not say anything about any other charges being due at all, or being charged. This person has also made threats of coming to the property with the police and lock up the property. Im sick of this guy, he will not give any contact information other than a address. I have requested a breakdown of our account and a pay off with a date when the loan is to be completely paid off. I have this info, but have always paid more than what is due. He will not respond to me, at all. Any recourse on my part?? By the way this is all in Texas. I was trying to search for a site where it has mortgage/loans rules that might apply to my situation. Any input would be appreciated.. I pulled out the deed..i have all the info and have sent "him" a copy with the pertinent info, but this guy is just..i dunno, hes something else.
