You are putting the cart before the horse. You should first of all interview several real estate agents to see if they are compatible with you and your thinking as well as if they work the neighborhood in which you are trying to sell your home.. . You must be wary of real estate agents that live 10 miles from where you are trying to sell your home. See if they have sell signs in your neighborhood, you will want someone that is local.. . You also want someone that is selling homes and not simply listing them with the hope someone will eventually sell the house for them.. . Then there the agents that will drop by and tell you they represent a buyer and would you be willing to pay a commission to them if they sold your house to one of their clients. You did not sign anything to pay them so let the people that hired them for for their services.. . Now about the commission. Your goal is to keep as much of your money in your pocket from the sale of your home as possible. That is your goal. The real estate agents goal is to get as much for selling your house as possible.. . Therefore the negotiation. I am sure two sane and sensible individuals with common sense can come to an agreement since both of you need each other. If the real estate agent don't want to negotiate and is stubborn and sticking to the normal commission then perhaps you should look elsewhere. The commission for a real estate agent is not set in stone, nor etched in a mountain.. . You are not involved in or concerned with how the commission is split between real estate agents, they will tell you that Oh, I have to split this with another agent and then there is the split with my boss. That is there concern. They will have to learn to ask for a larger share of the pie from their boss. Your concern is how much of your equity is flying out of your pocket into someone else's no matter the split. . . The agency has nothing to do with the commission, both large and small are attempting to getting the same thing.. . You might also interview a couple of discount agents like help u sell and others that assist individuals in selling real estate. There is even a For Sale By Owners web site you might be interested in.. . If you are a busy person and can't or will not take the time for open houses or fliers then perhaps a help u sell agent might not be good for you. But if you have the time what a good time you can have as well as learn about people. It's an adventure.. . The more options you have the better you are able to make an intelligent decision.

This is a case where husband under the influence of medicine was forced by wife to sign a legal document. So far all we have is hearsay. In order to prove husbands non voluntary involvement, it must be first proven that he was in fact under Drs care for the medicine and the effect the medicine has on him, then you would have to prove he was actually using this medicine at the time of signing and that in fact he had no idea what he was signing. Then you would have to prove that the wife had a criminal intent to defraud her husband by forcing him to sign. None of this would be easy to prove so he may be obligated to honor his signature on the document whether he really wanted to or intended to sign it.
